Both browsing the online shop and the acquisition of any of the products offered in it, imply acceptance as a user, without reservations of any kind, each and every one of these general conditions of contracting and use. VICTORIA CRUZ may at any time and without prior notice, modify these general conditions of contracting and use, as well as the particular conditions that, where appropriate, are included, by publishing these changes in the shop so that they can be known by users, and being recorded the date of such modifications.

We make every effort to offer the information contained in the website truthfully and without typographical errors. In the event of any error of this type occurring at any time, beyond the control of www.victoriacruz.es, it will be corrected immediately. All contractual information on www.victoriacruz.es is shown in Spanish (Castilian), and communication with clients and users, as well as the formalisation of the contract, will be carried out in this language.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content published in the store and especially the designs, text, graphics, logos, icons, buttons, as well as software, trade names, trademarks or industrial designs and any other signs susceptible of industrial and commercial use are subject to intellectual and industrial property rights of VICTORIA CRUZ or third party owners who have duly authorized their inclusion on the website. Under no circumstances shall it be understood that any license is granted or any waiver, transfer, total or partial transfer of such rights or confer any right or expectation of right, and in particular, alteration, exploitation, reproduction, distribution or public communication of such content without the prior express permission of VICTORIA CRUZ or the relevant owners. 6. OBLIGATIONS OF CUSTOMERS AND USERS

In general the user is obliged to comply with these general conditions, as well as to comply with the special warnings or instructions for use contained therein or on the website and always act in accordance with the law, good customs and the requirements of good faith, using due diligence, and refraining from using the website in any way that may impede, damage or impair the normal functioning of the same goods or rights of VICTORIA CRUZ, its suppliers, other users or in general any third party. VICTORIA CRUZ is not responsible for the truthfulness and accuracy of the data filled in by the user and therefore cannot verify the age of the same. Specifically, and without implying any restriction to the previous section during the use of the website www.victoriacruz.es the user is obliged to:

For what purpose do we process your personal data?

In compliance with the provisions of the European Regulation 2016/679 General Data Protection Regulation, as well as any national law that may apply, we inform you that in VICTORIA CRUZ we process the personal data you provide for the following purposes:

1. To process your registration as a customer, manage the purchase process as well as manage your contractual relationship with us.

If you withdraw your consent or object to the processing, the data will be blocked and will no longer be processed, and will be retained for a period of 4 years for the purpose of making claims or defending ourselves against possible claims.

The request to exercise any of your rights must be accompanied by a copy of an official document that identifies you, ID card, NIE or Passport. Likewise, we inform you that you can contact the Spanish Data Protection Agency and other competent public bodies for any claim arising from the processing of your personal data.

10. PLACING THE ORDER

To place an order it is necessary to connect to www.victoriacruz.es. You must add the product you wish to purchase to the basket, according to the instructions on the screen, filling in the order form provided and validating it. It is essential that the data on the billing and shipping form are correct, since VICTORIA CRUZ will reproduce exactly as written, without modifying letters, capitalization, punctuation marks, etc.. All specifications and other details that the buyer wants in the product, must be transmitted at the time of ordering. If the customer does not specify their customizations, VICTORIA CRUZ will choose the details by default, without the customer being able to reject it. VICTORIA CRUZ will not be obliged to ask the customer for the details that could be missing in his order for the manufacture of the product. However, VICTORIA CRUZ may, in cases where it detects an error, contact the customer at the email address provided in the form to request clarification of the missing information.

In this case, the delivery time will be suspended, and will be resumed when the customer responds to the request made by VICTORIA CRUZ. If in the above case, and having passed 60 days from the request for additional information by VICTORIA CRUZ, the buyer does not send any response, the order will be considered cancelled, and the price will not be refunded.

Once the customer has placed the order, with the inclusion of all the details and specifications desired, and has paid the price, and therefore the purchase order has been validated, no changes will be accepted for which will have 30 days to make the return in its original box and with all the elements that contained the package sent and the completed return form. The cost of shipping will be borne by the customer.

The prices and offers presented on the website are valid only and exclusively for online orders placed at www.victoriacruz.es, and may not coincide with the prices and offers in force in other shops associated with VICTORIA CRUZ in Spain. The validation of the order by the customer expressly implies knowledge and acceptance of these general conditions of contract as part of the conclusion of the contract. Unless proven otherwise, the data recorded by VICTORIA CRUZ constitutes proof of all transactions between VICTORIA CRUZ and its customers. VICTORIA CRUZ will file the electronic document in which the contract is formalised and this will be accessible. Once the purchase has been made and in the shortest possible time, always within 24 hours from the execution of the purchase, VICTORIA CRUZ Customer Service will send you by e-mail a proof of purchase.

11. RIGHT OF WITHDRAWAL AND RETURNS

We want you to be comfortable working with us, so unless the design has been customised, you can claim any incident in the following 30 days from the day you receive your order. Only returns previously authorised by VICTORIA CRUZ will be accepted. To request this authorisation, the buyer must first contact VICTORIA CRUZ through their sales representative, indicating the order number and explaining the incident.

12. WITHDRAWAL

You have the right to withdraw from this contract within 30 working days without giving any reason. The withdrawal period will expire 30 working days from the day on which you or a third party indicated by you, other than the carrier, acquired the material possession of the goods. To exercise your right of withdrawal, you must notify VC JEWELRY 1958 S.L.U. C/ Tomás de Villarroya, 10, postcode 46017 Valencia (Spain) by email: contact@victoriacruz.es of your decision to withdraw from the contract. You may also make an unequivocal statement of your decision in a letter sent by post or fax. To meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

14. AVAILABILITY OF PRODUCTS

The selection of products offered on www.victoriacruz.es is valid as long as the products are visible on the website, within the limits of available stock. Each product's data sheet indicates the period within which we can dispatch the product. If the goods are in stock, they will be dispatched on the next working day, with a delivery time of between 1 and 3 days. If, on the other hand, we do not have stock, we will make a request to the supplier, estimating an approximate delivery time of 10/12 working days.

VICTORIA CRUZ offers you different payment methods so that you can choose the one that suits you best: Payment by credit card: you can use Visa, MasterCard, Amex. If you pay by VISA or MasterCard, your card will be charged on a deferred basis, i.e. at the time of shipment. In this way, only the items shipped will be charged at the time of shipment. In the event that the POS informs the customer that the card has been refused, the order will be automatically cancelled and the customer will be informed of the cancellation online. For payments made with cards issued outside Spain, the issuing bank must be a member of the Secure Electronic Commerce Security Protocol (CES). Payments with cards that do not comply with this requirement will not be accepted.

17. CONSUMER GOODS GUARANTEE

In accordance with the General Law for the Defence of Consumers and Users and other complementary laws, all VICTORIA CRUZ jewellery is guaranteed for two years from delivery and we will proceed, as appropriate, to repair, replace, reduce the price or refund the amount of the product. If you need to make a warranty claim, please contact us by email at contact@victoriacruz.es. This warranty does not cover possible breakage or wear and tear caused by use. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.

No warranty will be provided in the case of:

- That the product is presented without the original warranty and/or an official receipt inscribed with the correct model code for the product.

- That the article has been modified or repaired improperly by a workshop outside VICTORIA CRUZ.

- Improper use.

In cases not covered by the guarantee, we offer our workshop service so that you can continue to enjoy your favourite jewellery. The following are not considered to be manufacturing problems: Normal use of the jewellery that leads to the loss of the rhodium plating or knocks to the crystals caused by use.

18. APPLICABLE LAW. SUBMISSION TO JURISDICTIONS

Purchases and sales made on www.victoriacruz.es are subject to Spanish legislation. In the event of any conflict or discrepancy arising in the interpretation or application of these contractual conditions, the Courts and Tribunals which, where applicable, will hear the matter, will be those provided for in the applicable legal regulations regarding competent jurisdiction, in which, in the case of end consumers, the place of fulfilment of the obligation or the place of domicile of the purchasing party is taken into account.
